REVA SOCIAL – MASTER TERMS AND CONDITIONS
(Applicable to Beta Testing Phase, General Availability, and Beyond)

1. ACCEPTANCE OF TERMS & ELIGIBILITY
1.1 Binding Contract
By creating an account, clicking “I Agree,” or accessing any service provided by Reva Social via revasocial.org (collectively, the “Platform,” “Service,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) enter into a legally binding agreement to abide by these Master Terms and Conditions (“Terms”).
1.2 Applicability Across Platform Lifecycle
These Terms govern your access to and use of Reva Social during its initial Beta stage, testing periods, local trials, and all subsequent commercial releases, feature updates, and general availability transitions (“and beyond”).
1.3 Eligibility Requirements
Age Limit: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to register an account. Minors are strictly prohibited from creating accounts.
Parental/Guardian Status: If you access the Platform as a parent, you represent that you are the parent or legally recognized guardian of any minor child(ren) participating in events discovered through the Platform.
Authority: If you register on behalf of a local business, organization, or merchant entity, you represent and warrant that you possess full legal authority to bind that entity to these Terms.
2. BETA STAGE DISCLAIMERS & PLATFORM EVOLUTION
2.1 Beta Status Acknowledgment
You expressly acknowledge that the Platform is currently operating in a Beta stage. Features, functionality, event listings, and user interfaces are subject to rapid change, experimental testing, maintenance windows, and temporary service disruptions without prior notice.
2.2 Heightened “As-Is” Beta Disclaimer
During the Beta stage, the Platform is provided on an “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS” basis. Reva Social makes no warranties regarding continuous uptime, data persistence, error-free code, or uninterrupted community event scheduling.
2.3 User Feedback License
Any feedback, bug reports, feature requests, or suggestions provided by you to Reva Social regarding the Beta stage automatically become the sole property of Reva Social. You grant Reva Social an irrevocable, royalty-free, perpetual right to implement, modify, and commercialize such feedback without restriction or compensation to you.
2.4 Seamless Transition
These Terms automatically remain in full force and effect as Reva Social transitions out of Beta stage into general availability and expanded service tiers.
3. ACCOUNT REGISTRATION & SECURITY
Account Accuracy: You agree to provide accurate, current, and complete information during registration and keep your profile updated.
Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.
Security Reporting: You agree to notify us immediately at team.revasocial@gmail.com of any unauthorized access or security breach.
4. PLATFORM ROLE & SERVICE LIMITATIONS
4.1 Information Marketplace
Reva Social operates strictly as an online communication and venue network connecting local families, community playdate hosts, and third-party merchant partners.
4.2 SECTION 230 SAFE HARBOR NOTICE
To the maximum extent permitted by law, Reva Social acts as an interactive computer service provider under Section 230 of the Communications Decency Act (47 U.S.C. § 230). Reva Social is not the publisher or speaker of any user-generated content, event listings, or reviews posted by Users.
4.3 NO CHILDCARE OR EMERGENCY SERVICES
REVA SOCIAL IS NOT A DAYCARE, CHILDCARE PROVIDER, EMPLOYMENT AGENCY, OR LICENSED SUPERVISORY SERVICE. Reva Social does not screen, endorse, employ, or manage individual Users, playdate hosts, or event attendees.
5. USER ROLE-SPECIFIC PROVISIONS
5.1 Parents and Caregivers
Mandatory Parental Supervision (No Drop-Offs): Parents or legal guardians must remain present and maintain direct, uninterrupted supervision of their minor child(ren) at all offline playdates, meetups, and events arranged via the Platform.
Health & Safety: You are solely responsible for managing your child’s health, dietary restrictions, allergies, physical limitations, and emotional well-being during any meetup.
5.2 Event Hosts and Curators
Independent Status: Users who host, curate, or organize community playdates or meetups do so voluntarily as independent Users, not as employees, agents, contractors, or representatives of Reva Social.
Public Safety Compliance: Hosts agree to hold events in safe, lawful environments (e.g., public parks, permitted commercial venues) and comply with all local municipal laws, noise ordinances, and park regulations.
5.3 Merchants and Commercial Partners
Fulfillment Responsibility: Business entities listing products, services, play spaces, or promotional offers are solely responsible for fulfilling those offers, maintaining commercial general liability insurance, and complying with all local health and consumer protection laws.
6. DISCLAIMER OF USER VETTING AND BACKGROUND CHECKS
6.1 No Mandatory Background Checks
REVA SOCIAL DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, SEX OFFENDER REGISTRY CHECKS, OR IDENTITY VERIFICATIONS ON ITS USERS OR EVENT HOSTS.
6.2 User Duty of Caution
You acknowledge and agree that Reva Social cannot guarantee the identity, background, conduct, or suitability of any User. You agree to exercise sound personal judgment, caution, and due diligence when interacting with other Users, whether online or at offline events.
7. ASSUMPTION OF RISK AND EXPRESS RELEASE OF LIABILITY
7.1 Voluntary Offline Participation
You acknowledge that participation in offline playdates, outdoor park events, physical activities, and group gatherings involves inherent risks, including but not limited to:
Physical injury, slips, falls, or illness (including communicable disease transmission).
Property loss, theft, or damage.
Unforeseeable conduct or negligence by third parties or animal hazards.
7.2 Express Release and Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU KNOWINGLY, VOLUNTARILY, AND EXPRESSLY ASSUME ALL RISKS FOR YOURSELF AND YOUR MINOR CHILDREN ASSOCIATED WITH USING THE PLATFORM AND ATTENDING OFFLINE EVENTS.
You hereby RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS Reva Social, its owners, directors, employees, affiliates, agents, and successors from any and all claims, demands, damages, liabilities, losses, or legal fees arising out of or related to:
Personal injury, illness, disability, or death suffered by you or your child.
Loss or damage to personal property.
Interactions, disputes, or tortious acts committed by other Users or third parties.
8. CODE OF CONDUCT & ACCEPTABLE USE
All Users agree NOT to engage in any of the following prohibited behaviors:
Harassment or Unsafe Conduct: Engaging in abusive, aggressive, discriminatory, or inappropriate behavior toward parents, children, hosts, or business owners.
Illicit Activity: Using the Platform to arrange illegal activities, solicit minors, or distribute unapproved commercial spam.
Contagious Illness Protocol: Attending offline meetups while exhibiting symptoms of contagious illnesses.
Data Mining & Scraping: Scraping, harvesting, or extracting personal data, child details, or photos from the Platform without permission.
Violations of this section will result in immediate account termination without prior notice.
9. CONTENT, PRIVACY, AND INTELLECTUAL PROPERTY
9.1 User Content License
By submitting text, photos, or event listings to the Platform, you grant Reva Social a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and adapt such content solely for platform operations and promotional purposes.
9.2 Children’s Media & Privacy Protection
Consent Required: You agree not to upload, capture, or share images or videos of other Users’ minor children without express parental permission.
COPPA Compliance: Reva Social does not knowingly collect personal information directly from children under 13. All account details and event RSVPs must be managed exclusively through the adult parent’s profile.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Reva Social, its officers, directors, employees, and agents from and against any third-party claims, damages, obligations, losses, liabilities, costs, or legal fees resulting from:
Your breach of these Terms.
Your (or your minor child’s) conduct at an offline event or meetup.
Your violation of any third-party right, including copyright, property, or privacy rights.
11. LIMITATION OF LIABILITY
11.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REVA SOCIAL’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE (WHETHER IN BETA STAGE OR POST-BETA RELEASE) SHALL NOT EXCEED THE GREATER OF $100 USD OR THE TOTAL AMOUNT YOU PAID TO REVA SOCIAL IN THE PRECEDING TWELVE (12) MONTHS.
12. GOVERNING LAW, ARBITRATION, AND CLASS ACTION WAIVER
12.1 Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any judicial proceedings shall be brought exclusively in the state or federal courts located in Santa Clara County, California.
12.2 Mandatory Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be settled by binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules.
12.3 CLASS ACTION WAIVER
YOU AND REVA SOCIAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
13. TERMINATION AND MODIFICATION
Reva Social reserves the right, in its sole discretion, to modify these Terms at any time by posting updated terms on revasocial.org. Continued use of the Platform following updates constitutes acceptance. We reserve the right to suspend or terminate any user account at any time for policy breaches or safety concerns.
